40 Congressmen Join Rep. Burton In Asking Brass To Drop Charges Against The Navy SEAL Three
WASHINGTON, D.C. – On December 7, 2009, the court martial of three Navy SEALs began over allegations surrounding their capture of terrorist mastermind Ahmed Hashim Abed, the man believed to be responsible for the infamous mutilations of four American contractors in Fallujah, Iraq, in 2004. Today, Rep. Dan Burton (R-IN-05) sent a letter to Major General Charles Cleveland, Commander of Special Operations Command Central, asking for all charges against the SEALs to be dropped. 40 Members of Congress signed onto Rep. Burton's letter, which was also sent to President Obama, Defense Secretary Gates, and Admiral Mullin, the Chairman of the Joint Chiefs of Staff. Rep. Burton issued the following statement after sending the letter today:
"What is happening to these three Navy SEALs is completely wrong. They signed up, not only to serve their country, but to do so in the most dangerous capacity provided by our government. The commanders gave these men a mission, and they executed it. They risked their lives to capture a brutal terrorist, and in their success, likely saved the lives of countless others.
"Not unexpectedly, the captured terrorist, a top al-Qaeda leader, followed his own training manual and complained of poor treatment by his captors in the form of a punch to the stomach and a cut lip. I find it infuriating and unconscionable that the three SEALs are now undergoing court martial as a result of those allegations. Instead of medals and commendations, our heroes are being met with twisted jurisprudence. This sends a backwards message to our men and women in the military who are charged with carrying out dangerous missions and must often use aggressive force in dealing with al-Qaeda and the Taliban.
"My forty colleagues in Congress and I are asking that the charges be dropped immediately, and for the Navy SEALs to be restored to their capacity within the Special Forces so they can continue the heroic business of fighting our nation's most wanted enemies."

I understand the decision by these men to seek exoneration through a court martial. What I do not understand is the apparent inability of officers within their chain of command to exercise their discretion to deal with this issue as a purely administrative matter. There was no need to even seek Non Judicial Punishment to resolve this issue. Had a mid-level officer pulled them aside and read them the riot act, these young men would have fallen back into line and likely refrained from like actions (if any) in the future. End of story. I question the judgment and the command ability of junior and mid-level officers within their chain of command who elected to go the NJP route at all. The evolution of this matter to its current status reflects a lack of leadership..., and the absence of common sense in their decision-making process. If the Obama administration wishes to view the fight against Al Qaeda as a legal action rather than a war, then let them send a phalanx of FBI agents to effect arrests in Afghanistan and Iraq rather than our Special Operations forces. Time to join a tea party.

I also understand that allegations of this kind, even if proven, are almost always handled through low threat administrative procedures. The terriorist's manual tells them to claim abuse when captured, because Americans go crazy over that. I do truly understand the times and the environment. Sir, As an active duty Hoosier, I wanted to provide you with a little perspective on your effort regarding the Seals who are being court martialled. While I fully understand the tactics that terrorists are trained to execute include making unfounded claims, I think your actions are somewhat one-sided. Consider the fact that the Seals being tried were given the opportunity for a non-judicial proceeding. Consider also the fact that it appears that they willfully and knowingly made false statements to their chain of command and tried to effect a cover-up. They broke the faith with their leadership. Consider also, that the very leadership that you are railing against in this case are the same operators who have been in the field and conducted the same missions for many years. You are essentially saying, "Hey, we have these young Seals here and we ought to be treating them as heroes" while conversely you are telling their leaders, "Your judgement is questionable and you should not be holding these young sailor accountable". After serving on 30 years of active duty, I can tell you that in my opinion, the reality of the situation is more likely that these young men did something questionable and then lied about it when questioned. The right course here is to place our TRUST in the leadership within the SPECWAR community to hold their personnel accountable. The alternative is an unthinkable breakdown in their ability to maintain their own ethical guidelines of conduct. I believe that unless you have ALL the facts of the case, that your questioning of the SPECWAR leadership serves no larger good and causes harm to the image of the SPECWAR community when we can least afford it. It is further my opinion that you owe the General a formal apology. While I am otherwise a staunch support of Indiana's elected republican representatives, I think you have made a mistake here and would hope you can objectively look at the other side of the issue.

To the Hon Dan Burton, US Congress: Dear Sir, I respectfully disagree with your position and attempt to influence the course of military justice surrounding the three US Service Members under the command of MG Charles T. Cleveland Concerning your personal attention and letter to MG Cleveland, I have served with him in the same organization or under his command on several occasions and have found this man to be a true professional. It is precisely the discipline and integrity these US Service Members violated that placed them in this position. Conduct unbecoming of a Non-commissioned Officer should not be tolerated, especially during times of war. While I do not know the facts surrounding this case, MG Cleveland alluded to his actions in his 15 December 2009 response letter to your office, that these Service Members were given the opportunity to accept non-judicial punishment for their actions. The Service Members elected to decline this form of punishment, which is their right afforded to them under Article 15, and chose to proceed with a court marshal. MG Cleveland’s position, as stated in his letter, was his “duty to take appropriate action to not only ensure justice is done, but also to maintain good order and discipline.” I am a Special Forces Sergeant Major with 32 years of service. I have spent my entire military career within the Special Forces community and can say without a doubt that I expect the members of my community and the Special Operations Forces community as a whole to display the highest professionalism, discipline, and integrity within our Armed Forces. Failure to do so hurts my community. However, the failure of our leaders to take the necessary corrective actions to rectify the infraction, including breaches in discipline and integrity, only engenders the perception and attitude that misbehavior is condoned. I do not expect our civilian population to fully understand the rigors of a professional military life and the discipline required to maintain such a profession but I do not expect them to interfere in such matters as well. As a member of the US Congress, you understand that it is necessary, from time to time, to sanction those members that violate the code of conduct or ethics of your institution. Likewise, that responsibility falls to military commanders. As you look to the leadership within the House of Representative for enforcement, I too look to my commanders for enforcement. Please respect our institution and the ways and means necessary to ensure that the professionalism required to protect this nation are intact. These heroes of America, all said they did not assault this mastermind of terrorism. Given the ethics that these men all possess, they should be believed. When these charges are dropped, I submit that Congress should issue a proclamation that the country appreciates the service of these Great American Warriors. To ask our active-duty warrior's to perform any mission that they are charged with and then not support the result is unacceptable. Moreover, these men had the character to not take a fall for a charge without merit. They showed overwhelming character by bringing the subject of the mission back alive. Finally, I would hope that you and others in Congress ensure that these SEALS are promoted and awarded. It is very sad that this is even an issue and more sad that a message likes this even needs to be written.

I was an Army Chief Warrent Officer 3 and I am Angry that these soldiers are even being charged or court martial . The charges need to be dropped and they need to be awarded medals for their Honorable service. Terrorists are the ones that murder , they kill innocents, put them away. This war, is not a game called, "guess who the enemy is?" I am a Vietnam Veteran who was with the 1st Marine Division, and we took old ladies prisoner, because they were just as capable of blowing us up as the NVA. This is not a war with a front line, and a uniformed enemy to tell the difference between civilian and enemy soldier, and mistakes will be made. However, in this case a mistake wasn't made, and war is hell on everyone involved, especially in guerilla warfare. I am for; "when in doubt, everyone is your enemy." take no chances, and you will have a better chance of surviving in this kind of war. These Navy Seals were doing their job, that they were trained to do in a combat situation, and they were taking no chances. They should not be punished for wanting to live.

My appreciation to Rep. Burton and all others that helped our first SEAL in his acquital process. We need to continue our quest to free the other two SEALs and show our appreciation for what they have done and continue to do for our country. This is the most absurd display of law enforcement that I have ever seen. I would like to see what the people that put these men on trial would do if they had to do their job. They risk their life for all of us and in return receive scrutiny with possible court martial and jail time for capturing one of the most evil Taliban alive. You didn't see the Taliban scrutinizing him when he killed and mutilated our people. I would of shot the Taliban square between the eyes and not flinched one bit. Dear Mr. Burton, I sent a letter to Joshua Gillespie on 4/23. These two fine are being used as scapegoats for some one else. A high ranking NCO or officer who don't want a blemish on their record. As a Veteran of the Viet Nam War, I applaud your stand along with the other 40. It really angers me that those who haven't been there do not know beans about what goes on when we are at war. Just like Lt. Calley took the fall, for someone up the chain of command, for My Lai. There is no way our fighting forces should subjected to such scrutiny as to be court martialed for when they are ordered to obtain intelligence information from a captive of this magnitude. I saw many instances of torture. Get Obama and Gates to walk into Senator John McCain's office and ask him if he was tortured. I can assure you what happened to Mr. McCain and his fellow prisoners was not a slap or a punch in the stomach. Personally, if I had been there, I would slapped and hit the bastard also with out a thought to his "purported" wellbeing. If I sound harsh, guess what? Even after 41 years the memories come in the night and haunt me, scare me, make me sweat, make me pretty angry and leave in a huddled pile in my wife's arms. Ask Abed if he gives a crap about what he did. He'll tell us all he's proud of what he did. Well, I am a very Proud American, which was the slogan for my unit in Nam, the 2nd of the 32nd Artillery. If asked, I would still to this day put on the uniform of my country and do what was asked of me. So would my Dad at 88 and I'm 63, he and I talked this evening and wept that we were not on the scene with our troops. OK. I'll get off soap box for now.
